Making a will can be a daunting prospect. At Symons, Gay & Leland our will writing department will ensure that the process is easy and straightforward.

It is particularly important ot make a will if you are not married or in a registered civil partnership, this is because the law does not automatically recognise cohabitants as having the same rights as husbands, wives and civil partners.

Drafting a will ensures that you have a legally binding document which clearly defines who is to benefit from your property and possessions after your death.

LASTING POWERS OF ATTORNEY
From 1st October 2007, Enduring Powers of Attorney have been replaced by Lasting Powers of Attorney.

Lasting Powers come in two forms – Property and Financial Affairs Powers and Welfare Powers

Neither of the powers will be effective until they have been registered at the Public Guardianship office – but you don’t have to register a Power immediately if you don’t want to. If it isn’t registered then your Attorney can not use the Power.

Registration at the Court does not mean that some one lacks the capacity to act for themselves

If you want a power of attorney immediately that doesn’t mean you have to make a lasting power. You could make an ordinary power of attorney, but the ordinary power will not be effective if you lose capacity.

PROBATE
When a person dies it is an extremely distressing time and the subsequent responsibility of dealing with the administration of the estate can be very difficult.
